A divided U.S. Supreme Court barred the death penalty for the crime of child rape,
saying a Louisiana man's execution would violate the constitutional ban on "cruel and unusual punishment."
The justices, voting 5-4, spared Patrick Kennedy from becoming the first person since 1964 to be executed in the U.S. for a crime other than murder.
Kennedy was convicted of raping his 8-year-old stepdaughter... meanwhile...
A divided U.S. Supreme Court slashed the $2.5 billion punitive damage award against Exxon Mobil for the 1989 Valdez oil spill to $507.5 million.
The justices, voting 5-3, said the original award, which would have been increased by more than $2 billion with accrued interest,
was excessive under federal maritime law.
The Nattering One muses... $2.5 billion is excessive for a company that pollutes and ruins a biosystem for decades?
And makes in excess of $40 billion annually? And is duplicitous in oil market speculation that costs Americans $5 a gallon for its own product?
